Need VA Pension Audit Help?

Veterans and Surviving Spouses of Veterans are contacting us about their “notification letters” regarding audits and proposed reductions in Veteran Pension benefits from the Department of Veterans Affairs. This chain reaction is due to the 2023 increase in social security income.

Also, the Veterans Administration is sending out audit letters stating that during the pandemic, VA pension cases were not subject to NORMAL data exchange review with the Internal Revenue Service (IRS) and/or Social Security Administration (SSA). Therefore, the VA is conducting lookbacks now to audit and review the self-reported income previously counted on the pension application against the income verified by the data exchange.

Millions of veterans and their families are eligible for Veterans Benefits but do not take advantage of them. Why? The Aid and Attendance Program

The VA Aid and Attendance pension program is available to veterans, or their widowed spouses, where the veteran served 90 days or more of active duty, with one day during a period of wartime. For an eligible veteran or widowed spouse, the Aid and Attendance benefit pays up to $2,642 for the veteran with a living dependent spouse and $1,432 (2023 pension rates) to a widowed spouse to assist with medical expenses and the cost of long-term care.

This benefit can help a veteran or widowed spouse pay anyone, including their child, for home care. It can also be used to help pay for professional care in the home, assisted living rent, nursing care, prescription drugs, insurance premiums, copays and much more.

The Aid and Attendance Program can allow a veteran or widowed spouse to pay for care, in their home or at an assisted living community, and can often help them avoid the need to apply for Medicaid or transition into a nursing home prematurely. The benefit can also help to preserve assets.

Eligibility Requirements:

• The veteran must have served 90 days or more of active duty, with one day during a period of wartime.
• The veteran must have received a discharge other than dishonorable
• The veteran or spouse must have monthly medical expenses or care needs
• Applicants must pass an income and asset test before obtaining Aid and Attendance

Net worth and income are both factors, and there are specific income and asset limits set by the VA. It is important to work with a VA accredited agent in filing for this benefit to ensure that you receive the maximum that you may be entitled to and to help your claim get processed as quickly as possible. Eligibility rules are complex however never assume you or your loved one is not eligible!
